Definitions
For the purposes of these Terms and Conditions

“Agency” refers to TakeYourBusinessOnline, the provider of web design, development, and social media management services.

“Client” refers to the individual who has entered into an agreement with the Agency for the provision of services.

“Services” refers to the web design, development, and/or social media management services provided by the Agency as outlined in the proposal or scope of work.

“Agreement” refers to the contract or proposal agreed upon by the Client and the Agency, including these Terms and Conditions.

“Project” refers to the specific task or work agreed upon between the Client and the Agency.

“Content” refers to all materials such as text, images, graphics, and other media provided by the Client or created by the Agency for use in the Project.

“Website” refers to the online platform designed, developed, or managed by the Agency on behalf of the Client.

“Completion” refers to the point at which the Project is finalized and ready for delivery, as determined by the Agency.

Introduction
These Terms and Conditions govern the provision of web design, development, and social media management services (the “Services”) by TakeYourBusinessOnline (“the Agency”) to individuals (the “Client”). By engaging the Agency, the Client agrees to these terms.

Services
The Agency agrees to provide web design, development, and/or social media management services as outlined in the proposal or scope of work agreed upon by the Client. Any additional services or amendments to the original agreement will incur additional fees as mutually agreed in writing.

Payment Terms

The Client agrees to pay 50% of the total project fee before the commencement of the project.

Completion Payment

The remaining 50% is due upon completion of the project, prior to the delivery of the final product or launch of the website.

Additional Fees

Any additional work requested by the Client outside the scope of the original agreement will be billed at an agreed rate and must be paid in full before the extra work is completed.

Subscription Payments

Monthly Fees: For ongoing services such as website maintenance, hosting, or social media management, payments are due on the 1st of each month.

Late Payments: If the Client fails to make the monthly payment by the due date, the Agency reserves the right to suspend or remove the Client’s website and content from the internet until payment is received in full.

Ownership and Intellectual Property

Ownership Transfer: Ownership of the website, designs, and content will be transferred to the Client upon full payment of all fees.

Non-Payment: In the event of non-payment or late payment, the Agency retains ownership of the website, designs, and content, and reserves the right to take the website offline until all outstanding payments are settled. The Client will not have any rights over the website or content until full payment is made.

Termination and Cancellation
The Client may terminate the agreement at any time in writing. In the event of cancellation, any payments made by the Client are non-refundable. The Client will be responsible for any outstanding balance for work completed up until the point of cancellation.

Liability
The Agency is not liable for any damages or losses arising from the use of the Client’s website, including but not limited to financial losses, loss of data, or business interruption. The Client assumes all responsibility for ensuring the accuracy and legality of the content provided for the website or social media.

Amendments
The Agency reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client, and continued use of the Agency’s services constitutes acceptance of the amended terms.

 

 Acceptance of Terms

Upon ordering one or more of TYBO’s services you hereby acknowledge and accept our terms and conditions which you will be bound by. If you do not agree then please do not place an order.
